Becoming a Qualified EEO Neutral Mediator

To become a qualified mediator for Equal Employment Opportunity (EEO) disputes, the U.S. Equal Employment Opportunity Commission (EEOC) sets specific requirements. These requirements are designed to ensure that mediators have the necessary knowledge, skills, and ethical grounding to effectively mediate EEO disputes, which often involve sensitive and complex issues.

Duration: 20 clock Hours (2CEUs IACET)

Delivery: Mixed (Online, In-person, Instrucor Led)

Key Requirements:

The training should include the following information:

  1. The ADR Act and its amendments, with emphasis on the federal government’s interest in encouraging mutual resolution of disputes and the benefits associated with utilizing ADR;
  2. The EEOC’s regulations and policy guidance with respect to ADR, 29 C.F.R. §§ 1614.102(b)(2); 105(f); 1614.108(b), and 1614.603;
  3. The operation of the ADR method or methods that the agency employs;
  4. Exposure to other ADR methods, including interest-based mediation, and
  5. Drafting the settlement agreement, including the notice provision pursuant to 29 C.F.R. § 1614.504 where the aggrieved party believes that agency failed to comply with the terms of the settlement agreement.

Traininig Outline: 

Module 1: Introduction to ADR and EEOC Regulations

  • Overview of the Administrative Dispute Resolution Act (ADRA) and its amendments.
  • Emphasis on the federal government’s interest in encouraging the mutual resolution of disputes.
  • Understanding the benefits associated with utilizing ADR in the federal context.
  • Detailed review of EEOC’s regulations and policy guidance concerning ADR (29 C.F.R. §§ 1614.102(b)(2); 105(f); 1614.108(b), and 1614.603).

Module 2: ADR Methods Employed by Agencies

  • Detailed exploration of the ADR methods employed by agencies.
  • Understanding the operation and application of these methods in resolving disputes.

Module 3: Exposure to Various ADR Methods

  • Introduction to various ADR methods, including interest-based mediation.
  • Comparative analysis of different ADR techniques and their appropriateness in various scenarios.

Module 4: Drafting Settlement Agreements

  • Training in drafting effective settlement agreements.
  • Focus on the notice provision pursuant to 29 C.F.R. § 1614.504.
  • Addressing scenarios where the aggrieved party believes the agency failed to comply with settlement terms.

Module 5: Neutrality and Confidentiality in EEO ADR

  • Understanding the role and importance of neutrality in ADR proceedings.

Module 6: Enforceability and Flexibility of EEO ADR

  • Principles of enforceability in EEO ADR programs as per Section 1614.504 of 29 C.F.R.
  • Flexibility in EEO ADR program design and implementation, tailored to agency-specific needs.

Module 7: Training for Managers and Supervisors

  • Specialized training for managers and supervisors in EEO ADR.
  • Role of leadership in facilitating successful EEO ADR processes.

Module 8: Developing an EEO ADR Program

  • Guidelines for establishing written procedures for EEO ADR programs.
  • Understanding the types of EEO ADR resources and techniques offered by agencies.
  • Insights into stages of EEO processes where ADR is applicable.

Module 9: Evaluation and Improvement of EEO ADR Programs

  • Methods for evaluating the effectiveness of EEO ADR programs.
  • Strategies for continuous improvement and adaptation of EEO ADR programs.
