This course reviews and examines the race and ethnicity based arguments in tort litigation. Litigants in tort litigation use expert witnesses who provide expectancy data on the total income an injured person would have earned if he/she had not been injured based on historical statistical data, such as that of the Bureau of Labor Statistics (LBS), with race and ethnicity as its focus. Courts have opined when and how such data can be used and argued on individual characteristic rather than on class/ethnicity characteristics.
