Participants will explore critical aspects of federal discrimination law, the EEO complaint process, mediation principles, conflict-resolution strategies, and related topics. The program combines expert-led instruction with practical exercises and hands-on mock mediation scenarios to create a comprehensive learning experience.
Participants will complete the program with the foundational knowledge, practical skills, and professional confidence needed to serve effectively as EEO neutral mediators and facilitate the resolution of workplace disputes.
EEO Neutral Mediator Training Requirements
The U.S. Equal Employment Opportunity Commission establishes training requirements for individuals who serve as mediators in the federal EEO process. These requirements are intended to ensure that mediators possess the knowledge, skills, impartiality, and ethical grounding necessary to address sensitive and complex EEO disputes.
Key Training Topics
The training includes instruction in the following areas:
- The Administrative Dispute Resolution Act and its amendments, with emphasis on the federal government’s interest in encouraging the voluntary resolution of disputes and the benefits of using alternative dispute resolution.
- EEOC regulations and policy guidance concerning alternative dispute resolution, including 29 C.F.R. §§ 1614.102(b)(2), 1614.105(f), 1614.108(b), and 1614.603.
- The operation and application of the alternative dispute resolution methods used by federal agencies.
- Exposure to additional ADR methods, including interest-based mediation and other collaborative approaches to dispute resolution.
- Mediation ethics, neutrality, confidentiality, impartiality, and the appropriate role of the mediator.
- Communication, active-listening, questioning, reframing, negotiation, and conflict-management techniques.
- Drafting settlement agreements, including the notice requirements under 29 C.F.R. § 1614.504 when an aggrieved party believes that an agency has failed to comply with the terms of a settlement agreement.
Program Schedule
Day 1: Foundations of EEO Mediation
Overview of the federal EEO process, discrimination law, ADR principles, mediator ethics, confidentiality, neutrality, and the mediator’s role.
Day 2: Advanced Mediation Skills and Techniques
Advanced communication, active listening, questioning, reframing, managing impasse, negotiation strategies, and settlement-development techniques.
Day 3: Mock Mediations and Professional Feedback
Participants apply their knowledge through structured mock mediation exercises and receive individualized feedback designed to strengthen their mediation skills.
